Hello,

we have again increased TE with the constellation:

1. Life partnership child de or in planning. Man finances alone or with partner. Woman does not go into the land register and does not have to pay anything for the house. But she is allowed to look after children part-time

2. Marriage, man finances with or without woman. Goes alone in the land register. Woman is allowed to look after children part-time

How does the community of accrued gains work? If the man pays off his property. Does the woman get 50% of the repayment in case of divorce? Does she get 50% of the increase in value?

Do you think it's good that a man does his own thing?

Good? No, every woman who is not listed in the [GB] should at least work full-time if possible, otherwise she really has poor chances if things go wrong. In such a case, I would also pay at most some kind of proportional rent. Or rather, something like that won’t happen with me anyway, because [vh], listed 50% in the [GB] and contributed 45% of the house capital. If things fall apart between us, he has to "at least" pay me out...

I would never have made myself dependent on my husband or boyfriend. That’s probably why I don’t have a child. That’s why I have a house with my husband.

I find it terrible that when it comes to "creating a family, having children," etc., people don’t even have the maturity to think about stability, reliability, and togetherness. Instead, they want to continue living single-mindedness within the partnership.

I don't think that repayment is automatically the appreciation, the debts just decrease... ah, no idea

If the repayment during the marriage is made from funds earned during the marriage (e.g. from current salary), in my opinion she is entitled to half. Assuming the value of the repayment still exists at the time of separation.

Land register or not. That only means that he can kick her out because it is his property, his right of residence.

In the mentioned thread, a BGH ruling is indeed referenced. If that reflects the current case law, then everything is all good. Well, at least the partner who is raising the children and not working is not left completely destitute. That such a separation of assets does not at all fit my understanding of partnership—especially not with children—is another matter entirely.
