Thank you very much for the information! Would the approval of a carport outside the buildable area still be possible through the exemption procedure, or would it necessarily require a permit procedure?

How old is the precedent? - for a discretionary commitment, all essential principles must be the same!

The precedent case (at least 10 years old) is based on an old development plan for the former half of the street, which has now been extended into the new development area. However, the justification of the new development plan mentions that the old development plan is to be continued in terms of design. Does that then serve as an argument?

Since, according to your own statements, you are not violating any stipulations of the development plan, I see no obstacle. Even if you fall short of the 3 meters required by the GaStellV, I do not see the conditions of Art. 58 BayBO as being violated. However, your draftsperson must take responsibility for that. They also know many more details than the forum.

Thank you, that helps enormously with the argumentation with the [Gemeinde]. It would be a tremendous relief for the planning if that works out.

Here’s another question , what width would you recommend for the dressing room if you want to place two 60 cm wardrobes opposite each other and still be able to get through in between?
