I think it is understandable that as a builder you like to put the floor plan under your pillow, discuss it calmly, show it to other people again before pressing "Buy".

Well, it is also common that even after signing the purchase contract, you still have the possibility to change the floor plan.

It's not like you sign the building application at the same time as the contract. Whether the wall ends up further right, left, or somewhere else is not necessarily relevant to the price.

In our case, even after the building application was approved, small changes were still made. Only once the structural engineer completed his calculations was the floor plan locked for changes.

That's true, he told us the same. Maybe we are also a bit too cautious and should have a little more trust.

But – an offer is far from being a contract for work. It will be the case that the offer is used as an annex to the contract for work; incl. floor plans. How else can you be sure what exactly you have bought?


First of all, I find it troubling that you have to ask these questions here in the forum. I would have expected your potential contract partner to sufficiently inform you!

An offer is and remains an offer; it is not signed but becomes part of a contract for work yet to be signed. _Before_ you sign it, however, you should familiarize yourself with the wording of the contract for work; if necessary have it reviewed by a lawyer, if there is a need. Only when you understand everything, offer, service + price are right for you, should you sign

Yes, you should be cautious and especially remain so. Hopefully, your potential contracting partner is well-versed in the contracts they conclude, whereas you naturally are not. A healthy degree of skepticism is definitely appropriate.



Based solely on this paragraph, you should be cautious with yourself and seek professional help to have what you are signing reviewed.

With acceptance of an offer, a contract is concluded (two matching declarations of intent); whether this is already the case upon signing the aforementioned offer (i.e., acceptance by you) depends on the wording. If a contract has thus been concluded, your negotiating position for a detailed contract naturally deteriorates significantly.

The document does NOT have to say "(work) contract" in order to be a contract! And just because it might say "(work) contract" on it does not mean it is a contract that is better for you.

Well, a phone call sometimes creates clarity.
The offer is really just an offer and not a contract; nothing needs to be signed for it. If we now say we want to build with you, a contract will be created on the basis of the offer with all the bells and whistles.
It may well be that our construction consultant also said that, but it got lost in the flood of information.
I will have the actual contract reviewed by the Bauherren-Schutzbund. Greetings and many thanks for your answers.
