A lot depends on the quality of a declaration of division. Since 12-2020, a new WEG applies. I would ask to see the latest minutes. I would check whether the community was able to make sensible resolutions without an administrator and, depending on the year of construction, also save something. Communities with clumsy resolutions, a stupid declaration of division, and those without reserves (...we can just make a special assessment, we are all solvent enough) will sooner or later get into trouble. There is no house money or similar. According to the declaration of division, everyone is responsible for their own specially used common property. Also regarding costs. Only the communal paths are shared. But that is usually the case.

Much depends, as already mentioned above, on the declaration of division. We currently live in a condominium with a garden share (approx. 100m2) as a special usage right. There are 3 ground floor apartments in the building. According to the declaration of division, we are responsible for the care and maintenance of the garden. All structural changes require the approval of the others (according to the new [WEG]-law, it no longer needs to be 100% of the owners). We wanted to enlarge the terrace/change the decking and put up a shed, which went without problems. However, the hedge must be uniform for all 3 ground floor apartments...

I consider exactly such inaccuracies (referring to special users as owners) to be problematic.
