It is about the fact that the architect/engineer overall did not work in our interest. Wishes were not considered, information was not passed on, and other issues. He is not a member of any [Kammer], so the [Schlichtungsstelle] is out of the question. A meeting with the lawyer is scheduled later.

You can basically already prepare yourself for the lawyer to negotiate a settlement for you. You will then pay half of the demanded €9700 and be stuck with your own legal fees.

Talking usually helps more than rushing straight to a lawyer. But everyone has to pay their learning fees in this regard at some point.

Judging by your resistance to advice from the other thread, I can only wish the architect success.

There are people you just don't want to work with.

An architect is, to my knowledge (if not employed), a compulsory member of the chamber. He owes an approvable plan - but not that the client must find it phenomenally beautiful. Thus, his fee claim is also not subject to any condition of approval. What are objective criteria for poor performance in your case?


To my knowledge, HOAI does not know of tied sales from purchase or construction contracts and planning services (?)

since it can be expected that anyone who takes xxxxxxk into their hands to build can also read a contract where a few numbers are also included

Then I'll try to keep it a bit more neutral.

How is your contract set up? Have you defined that after each service phase you have to approve the results? If yes and this has not happened, so that the architect simply continued, then you may have a good chance to contest the €9000.

To me, an invoice of €9000 sounds like for service phases 1-3 or possibly also service phases 1-4, right?
