Dear forum community,
We recently purchased a condominium in a historic monument. The purchase was made in an unrestored condition from the owner. The expansion of the residential unit will be carried out by us in cooperation with an architect commissioned by us.
For this purpose, an architect contract based on the HOAI was concluded.
It is a very complex expansion of an attic apartment including the stage above it and a living area of 162 sqm. The estimated construction costs amount to approximately 190,000 euros net.
I have attached the details.
The following services were agreed as "additional services" in the contract – here:
Inventory/measurement: 2,200 euros net (service phases 1-3)
Electrical planning + tendering: 1,800 euros net (service phase 5)
Sanitary planning + tendering: 1,500 euros net (service phase 5)
my 1st question:
Are these services not already covered by the payment for service phases 1 - 5 according to HOAI? Is it allowed to charge a separate surcharge for these?
my 2nd question:
Since it is a historic monument, the bank requires an energy saving regulation concept for granting the Nr. 151 KFW program. The architect cannot provide the energy saving regulation proof himself (in our opinion, however, part of service phase 3 - according to Wikipedia), but the architect did not tell us what costs to expect for this.
Question: is the energy saving regulation proof part of the architect’s fee for service phases 1-9, which in our case is quite generous at approximately 54,000 euros?
