Sale Fingerhaus work contract

Hello and good evening,

I am using this forum now out of personal interest, hoping that a suitable builder reads this. In April 2021 (before various price increases), we signed a Fingerhaus contract for a family house including a condominium. For very private reasons, this contract can no longer be realized. We now have the opportunity to sell the existing contract including all signed prices to a third party, a new builder. This person would then be able to build a house that we planned, which is significantly more expensive at today’s prices. It would thus be beneficial for both sides. Otherwise, as a family, we cannot get out of the contract without immense costs. Perhaps someone here might seriously be interested. We would be happy to provide further information about costs and the floor plan, etc.

Maybe that's a bit too little as a description.

How is someone supposed to be interested in something if they don't know what you're offering.

You basically want to sell a contract that was created based on your wishes.

I can hardly imagine that anyone will be found given the interest rate development of the past few months.

Aside from that, this is not a sales portal. There are other options online for that. For example, anywhere where someone lists real estate.

Aside from that, I doubt that the contracting party will agree to this sale so easily. I would be surprised if there are no appropriate clauses in the terms. It is not for nothing that the contracting parties are explicitly named in the contract. Contract from April 2021 .. there is also the further question of whether there are already contractually regulated price increase options for the contracting party.

I don’t need a contract, my house is almost finished ;) But is the sale agreed upon with [Fingerhaus] or will the potential buyer be in for a surprise, because [Fingerhaus] would rather collect the cancellation fee from you and the current prices from the new interested party?

Simply placing a finished floor plan on another plot of land will not work. Additionally, the building authority [BP] also has a significant say.

I read from this that the contracting party has agreed to the provision of a "subtenant" *grin* or even suggested this as a possibility. I also consider the assumption that this would be connected to a contract entry at pre-price increase conditions to be wishful thinking. This all sounds pretty crazy; I only know about trading allocation-ready delivery contracts from my youth and from Mercedes cars ;-).
Why don’t you just sell the land together with the construction contract?
You should at least mention the model and size. And I join the suggestion to choose a platform for this offer where private contact between newbies is also possible. For example, a classifieds paper in the area of the property.
