Purchase of land with an old barn that is also used by the neighbor

Good day. My name is Kai and I come from the Freiburg area. We would buy/measure and divide a plot of land with 620m2 together with my wife's sister. On the property, there is an old burned-down semi-detached house, and the neighbor next door has the other semi-detached house. We would also build a house there again. Everything is also clarified with the authorities. Now the actual question. Behind the house, there is a two-story barn on our property and on the neighboring property. (quasi barn semi-detached house). We have to completely demolish the barn on our side because we cannot use it for the construction project. The barn is very old, and I think if we partially demolish it, the roof will fall on the neighbor's side inside the barn. What do we legally have to consider? Can we simply demolish it, and does he have to take care of the stability on his side himself? Thank you very much in advance. Regards Kai

A building may not stand on two plots of land. Or rather, the subdivision must not create a legally impermissible situation. So the barn must go.

Welcome to the forum, the barn is a post and beam construction and is only stable as a whole in wind, weather, and snow. Comparable to a house of cards, try dismantling half a house of cards ;)

just a quick info: the barn is separated by a masonry wall = property division. he doesn't want to pay money, we can tear down our side but he wants his part to remain standing and be reusable. he is willing to make compromises like reducing the roof coverage from 4m to 2m, for example. but he doesn't want to pay or do anything. the barn is so old that it is not even listed in the building encumbrance register? (no idea if building encumbrance register is correct) the problem is that with my knowledge (automotive master technician) i see a problem in that the barn is so old that even partial support etc is wasted money....... thanks

why don’t you get an expert? I’m a layman, but why should the neighbor pay anything or do anything at all if YOU want to tear down?
