Price increase despite fixed price!

It’s not that simple either. Everyone calm down. Even Corona was only a reason for the 313 in isolated cases (e.g. possible rent reduction due to business closure ordered by the state). The hurdles are incredibly high.

In your opinion, will 313 still be applicable to building projects that have been underway for some time, relatively close to completion? Our house handover is scheduled for early to mid-July and I am very afraid that our home builder will now demand another price increase (the last one was about 15.4%) because the further the construction progresses, the harder it is to find someone who will finish the build if our builder quits. Fortunately, we built without any subsidies, so at least the frequently mentioned termination reason here does not apply in our case. Corona is also rather unlikely, since our price increase was issued in Sept. 2021, so "war" remains the only reason for termination or price increase. I am already scared to go to the mailbox every day.

I assume that right now a lot of hot air is being spread. And first, a trip to the Federal Court of Justice (BGH) will be necessary.
For almost completed projects, the whole stress (for the contractor) is no longer worth it. Just to claim a few euros for a (so far not yet occurred) price increase? Especially since it does not mean that the customer would have to bear the price increase alone, if § 313 is used.

How much is still outstanding on your side? Then you get a feeling for what it could be about. Let the still outstanding amount increase by 30% until July. You then pay the contractor 20% of that. What are you even talking about then? ==> Rhetorical question ;)

I am curious when the notification will come to us. Signed in November 21, fixed price guarantee for 15 months, and after we had fulfilled all our obligations in February, we got a planning meeting in June. That means no shovel will touch the ground this year. The statement that twice as many houses were sold as the previous year is interesting. (Thema KfW). I am curious whether they now want to pass the buck to us, although they blindly sold houses and cannot keep up with the orders, which, of course, seems hardly sensible in the current times.

I also find that interesting and cannot reconcile it with the information that so many builders are now receiving cancellations from their construction companies. What good is it to sell twice as many houses if they are not being built because the builders are being canceled beforehand?

Really intense what’s going on in the industry right now. Personally, I have never really believed in these price guarantees. It reminds me of the job guarantee in corporations, which you can wipe your ass with if the company doesn’t make a profit – then it’s pointless.

My general contractor even completely refused to agree to a price lock. There is now a material price clause (labor costs are excluded). It was agreed to have a monthly financial check-up until the start of construction to see if prices actually rise to unaffordable levels, because then you still have the option of “free termination” according to § 648 of the Construction Code. Since the general contractor can basically only bill his hours before construction starts or is entitled to “five percent,” the financial damage for the client remains manageable.
