The annoying thing about the gate is that using it can definitely leave marks on the car. And just the indication (garden gate) is unfortunately not proof if you want to demand the removal of the scratches from the neighbor. I would at least insist in the owners' meeting that the gate must be permanently locked. If that is supposed to be an escape route, then your BT (well, that of the neighboring house, but it's the same one) should please demonstrate how they intend to meet the minimum dimensions with a parked car ...

What for? Do you think they need an escape route out there? They probably have a way to the street from the entrance side in case of fire

No idea. Which developer just spends money on a gate like that?

So now it is about the fact that a (optional) garden gate has been installed from the neighboring garden, the use of which will presumably require squeezing along the OP's car? I would probably give them the finger. The parking space is absolutely usable, especially when parking in reverse I see zero problems there.

Thank you for the many pieces of advice. It is simply a planning error and therefore I have to deal with the developer. Structurally, it can no longer be changed. The plot with the gate belongs to the same developer and he refers to an emergency exit, which is a joke. I know many middle houses that do not have an emergency exit at the back.

If he thinks this is an escape route, you would actually have a lever, because escape routes must be kept clear at all times. Using it as a parking space would then be critically questioned. But you must be aware that structurally, nothing will change significantly. In the best case, it will come down to a reversal for you. However, you will not gain a parking space from this.
