If I back into the parking space, I have to get out on the side of the fence, how is that supposed to work?
The A-Class has mirrors in 2022, see photo
So there is only a space of about 42 cm left to open the driver’s door, that’s a fact.
So you have 246 cm width. The right mirror doesn’t need quite as much space since when opening it won’t be at a right angle to the fence. Even if it were, 42 cm is sufficient! Most parking garages have 240 cm width and there are spaces there that have walls on two sides. What this is not sufficient for is a parking space AND a garden gate.
Yes, own cadastral number and same builder
I informed the builder that there is no right of way
Builder is irrelevant, both houses have already been handed over, right? The fact is that now two parcels exist. You have rights on the first parcel. Such as the parking space. Use it as such! For example by parking your car there and making the gate impassable.
How and where the special usage rights from the second parcel can be exercised need not be your concern! Their administration or the owner of the garden apartment should please take care of that – their problem, not yours! They should create a proper path for convenient access without disturbing you. And a rescue route is out of the question right away, because then your parking space would be gone and no one could conjure up a replacement in such a case. If there should be a rescue route at that spot, it must be relocated. But again: not your problem, but that of the owners’ association or the property management of house 2.
