Why do you assume that the garden will always be shady? There isn’t much neighboring construction up there anyway. If you look at it that way, I would say: there is a house to the south that would cast a shadow on your house.

Is the house the right size? You’re not allowed to build that big, are you? What if the same thing is built on the property again?

Are you sure about that? We have significantly more than 6 m distance and the neighboring house sometimes casts a shadow in summer, thank God. It is as tall as ours, 2 floors.
