Yes, that's really terrible. Farmers are often hit particularly hard. When it fits.

There are new findings; as it currently stands, the shed belongs to us, although it is located on the neighboring property. In the land register, a residential house + outbuilding is registered under our parcel number with a note of an encroachment on the other parcel number (indicating the encroached m²). The neighboring property is only registered as garden land. According to the Building Code, this means that the shed is only a tolerated encroachment and therefore remains the property of the land from which the encroachment originated. The neighbor could probably demand rent for the encroachment or demand that we buy the encroached area from him at the price valid at the time of the encroachment. This was at some point around 1600 AD.........:)

Now we can (after legal review by a lawyer) simply demolish it without approval. Much better, however, is that we can even use this tolerated encroachment for a new house (which we do not want, but a future buyer will be happy about 64m² more floor space!) if we keep the foundation walls of the encroachment.....ah, joy rises in me!

Does anyone know how much of the shed must be preserved in a new construction so that the built-up area does not revert to the neighbor?
