But it is actually the case that there are no encumbrances recorded in the land register. However, there is a clear designation of the parcel numbers with the buildings erected on them. The lawyer has received everything from me, even notarized contracts dating back to 1920.

A tolerated encroachment certainly does not entitle one to a new building, but if the barn is preserved, its extension is no problem. The question remains how much of the original must be preserved.

And even if that is not possible, I am definitely allowed to demolish, including the shed on the neighboring property.

In Bavaria, there is no register of building encumbrances; everything must be recorded in the land register.

I wouldn't think that you can build on the neighbor's land either. Expanding the shed seems like nonsense to me if a modern new building is supposed to be built next to it. Who wants that? What I could imagine, however, is that the lawyer might be able to enforce a border development or at least a smaller distance to the boundary - possibly. If not, no big deal either. Small houses are nice too.

Who is talking about a "modern" new building? A beautiful new building with a directly attached and nicely renovated barn is an architectural highlight! Otherwise, no one would renovate an old farmhouse but everyone would only want to build new. There would even be subsidies from the state in that case.

But maybe I will get the neighbor to simply buy my side through the pressure created in this way. Then everyone would be happy.

Can't the barn just "collapse like that"? If it is at immediate risk of collapse, couldn't it collapse at any time?!
