I also found this online about it:

"VII. Measures for saving energy 1. Measures for saving energy are only considered as a substitute measure according to § 7 paragraph 1 number 2 if, in the construction of buildings, a) the respective maximum value of the annual primary energy demand and b) the respective requirements to be met for the specific building regarding the thermal insulation of the building envelope according to the Energy Saving Ordinance in the applicable version are each undercut by at least 15 percent."

Accordingly, I can also fulfill the Energy Saving Ordinance through energy saving (e.g., through insulation).

What does that mean in practice ..... with the 15%?

I already wrote that in my last post on the topic. A solar system is currently not an absolute "must" if the requirements are met otherwise. The 15% rule is an alternative.

I thought I had written that clearly... The Energy Saving Ordinance requires a certain maximum energy demand per m² of living space... it doesn’t matter how you achieve that, a reference building is calculated. To put it exaggeratedly, you could have simple glass panes as windows if the rest is insulated so well that the total sum fits again.

The requirement for renewable energies comes from the:
Gesetz zur Förderung Erneuerbarer Energien im Wärmebereich
(Erneuerbare- Energien- Wärmegesetz - Erneuerbare-Energien-Wärmegesetz)
Part 2 §5 paragraph 1
So it has nothing, absolutely nothing and no connection at all with the Energy Saving Ordinance.

P.S.: Of course, I refer to the original topic! A gas condensing boiler always requires a renewable share. Regardless of whether solar or otherwise.

Scarfy, you do realize that you are contradicting Bauexperte with that, right?

In any case, I agree with Bauexperte that through compensatory measures ([Erneuerbare-Energien-Wärmegesetz Teil2 $7 Abs. 1 Nr. 2]) a gas condensing boiler can also be used without solar thermal or other renewable energy sources.

[Erneuerbare-Energien-Wärmegesetz Teil2 $7 Abs. 1 Nr. 2]:
"The obligation according to $ 3 paragraph 1 or 2 (to use renewable energies) is considered fulfilled if mandatory measures to save energy are taken in accordance with number VII of the appendix to this law."

Number VII of the appendix:
a) The maximum value of the annual primary energy demand AND
b) the requirements for the thermal insulation of the building envelope
according to the applicable Energy Saving Ordinance must be undercut by at least 15%.

For a Kfw70 house, for example, one must undercut the annual primary energy demand of the Energy Saving Ordinance by 30% and the thermal insulation of the Energy Saving Ordinance by 15%.

So it should definitely be possible.

sorry, I didn’t know you’re not allowed to contradict a mod. I’m just repeating the stuff they taught us at the master school (SHK). Unfortunately, I can only quickly find terms on the internet and a value of 40 W/m²*K for the building envelope as the "worst" energy saving ordinance value. I would need to look at that more closely and/or calculate it again. I also need to take a closer look at § 7 Abs.2 and Appendix 4. I’m not a lawyer, but if I understand it correctly at a glance, it partly refers to CHP systems. (I was never really confident with the whole thing about § paragraph sentence number.)
