We are building on Wilmersdorfer. We want to...
The responsible clerk at the lower building supervisory authority is away until next week.
It doesn't matter what is stated anywhere. If the forestry authority confirms the forest character as part of the input during the approval process, then it is forest. If it lies within the inner area, it must be converted.

Who is the caseworker? Ms. D.? She promised that our building permit would come last week.

can you say if it is Mrs. D.? If she is away this and next week, I am curious how the building authority intends to meet its deadline, which ends this week. Or do the legal deadlines only apply to the builders?

I just spoke with the lower building authority. The lady (Ms. D.) is supposed to be back from Monday. I will call her substitute tomorrow (during office hours) and if we do not find a solution, I will speak with the head of department.

I can warmly recommend the following thread to you, there are sometimes horrifyingly long approval periods: https://www.hausbau-forum.de/threads/dauer-bis-zur-erteilung-der-baugenehmigung-in-bw.37389/

In BaWü, there is a statutory deadline in the state building code of a maximum of 3 months and 10 days after receipt of the building application. The authority has 10 days to check the completeness of the documents and then 3 months to decide on the building permit. For us, it was 6 months and nobody cared.

As our architect said about another construction project that had already waited 1 year: Administrative lawsuit takes 1.5 years and later only says that they have to decide – but not how.

I know this is a sad topic and you desperately want to start, but I can only recommend always staying polite and not complaining about the people to the supervisor – I hardly believe this will have a positive effect on the decision.

We had waited a long time and been very patient. But at some point, that comes to an end. I spoke with my future neighbor and also with the general contractor. The neighbor went the same way and got the building permit 2 days later. I will not shout around but will insist on the building permit in a friendly but firm manner.
