Local building regulations - Gabion fence allowed?

Hello everyone,

After our garden and gravel were raised for the terrace construction, we are now faced with the question of whether we can or may use a fence with gabions and covering fleece as a wall.

The building regulations specify the following:

1. Retaining walls, among others, are not permitted
2. Freestanding walls only up to 50 cm in height
3. Metal fences are allowed up to 150 cm
4. Privacy screens up to a height of 180 cm
5. On the border to public roads, enclosures may only be built up to 50 cm
6. Other enclosures along the border are permitted up to 150 cm.

Starting point: our house is on a 90 cm single-family house level. Our garden will be raised to this level. The garden borders a public footpath. Our plan would now be to set 143 cm gabions and fill in the soil. The gabion fence will largely not be visible from the inside.

What do you think about this, or do you have better suggestions based on these regulations?

Then the gabion retaining walls are therefore prohibited.

What does the development plan say about terrain modeling?

That a slope crown can be created. However, due to the specified height, we had to raise the house by 1 m above the actual level in some places. As a result, we already need a support where the gravel lies in order to comply with the regulations for splash protection at the house (30 cm gravel strip).

Currently, we are losing about 95 m² of area due to the level.

Slopes also work at quite steep angles, even over 45°; they just need to be secured accordingly with mats and plants.

The described measures are intended for the property boundary. On the property, in my opinion, you can install the gabions.

Just upload the property plan from the building application.

Then sketch what you want to install where.

Attached is our sketch. It wouldn’t be perfect, but it would at least give us a large part of the area.

Also, a brief excerpt from the BAP. Here is the difference to the municipal land at one meter; the further you move away from the house, the greater the difference between the property and the municipal land. At the peak, the difference is about 1.5 meters.
