I have now understood where to find them. What I haven’t understood is at whose instigation the administration spent so long developing a development plan for only a single construction project.

That is not correct. The emergency committee merely approved the agenda for the regular municipal council meeting on 28.05.2020 a little over two weeks earlier. There, the administration’s proposal to adopt the development plan as a statute was rejected by 7 to 8 votes. Curiously: The SPD refers to the decision of the local council, which had opposed the development plan three weeks earlier with one no vote and six abstentions (!). Overall a very remarkable and interesting case.

What is the relationship with the residents and owners of 17a? If they grant you a building encumbrance or are even willing to exchange a part of their plot, you could also build without a development plan.

Why it all took so long, I do not know myself. Since this was the first application, I didn’t know any better either, but I found it strange.

Yes, the application proceeded exactly like that. A brief letter to the mayor, who then forwarded the application to the administration.

We only had telephone contact with Ms. Thewes, who works at the municipal administration and set everything up.

As you have read, the relationship with the neighbor is more than poor since he is strictly against us building next to him. He just doesn’t want to lose his beautiful view of the field. That has also been the case since May last year. Due to insults, unauthorized entry onto my property, and a fence we lawfully erected because the nice neighbor stored his wood etc. there, we are going back and forth with the lawyer and meanwhile also with a mediator.

I don't understand that. It's still in the outer area anyway. Apart from that, as 17a I wouldn't want my south/west side to be built on. Edit: Just as I suspected. You don't really want to build there if it’s already escalating beforehand?

But actually, I do want to build there. I also don't want to be bullied by the neighbor just because he doesn't like something. Since I plan to build roughly the same as the neighbor, I would basically have him sitting at the back wall of the house. Therefore, the front door and garden would be on the other side, and I wouldn't hear or see anything from him.

Wrong goal – you are building for your quality of life and not to avoid being beaten down. That is a misconception. Try to work things out with the neighbor – no matter how stuck the situation is now. Almost every person has wishes or problems where they are approachable. You don’t have him on your side yet – now you can only win. Later you might have a lot to lose. Building against a neighbor can be nerve-wracking for years – depending on how they are and who they get along with. I wouldn’t put myself through that.
