With us, it is like this (statements from both the bank and the energy consultant):
If you have previously built with KFW40 at old terms, you can waive the loan and apply for KFW40+ if the loan has not yet been partially disbursed and if the construction progress is still below 50% (it is decisive whether windows and roof are completed).
Then you receive the new conditions of KFW40+. However, if the 40+ standard is not met at the end of the construction phase, you will receive no funding at all. You can only switch once in total and that has already been done from 40 to 40+. A further switch from 40+ to 40 or 55 is then no longer possible.
That would mean that if you initially applied for KFW40 and it only becomes KFW55 in the end, you switch to KFW55 and receive this funding. However, whether this is then under the new conditions, even if KFW40 was applied for under the old conditions, I do not know. But I can imagine it.
