Is there a warranty also on heating / air pump?

Hello, unfortunately I have to dig up the thread ... pump broken again. Same part again. Costs about €2,600. At that time it was declared a material defect by the manufacturer. That was 2 years and 3 months ago. Let's see if it goes smoothly again. A call to the developer brought this statement: excluded from any warranty. It is stated in the contract. After briefly checking, I can't find anything about it. And now? Show the damage in writing? The customer service is coming next week.

You can completely forget the developer. The heating belongs to the house and you have the warranty for it. He can exclude any maintenance joints but then it’s over.
The problem will be to get him to do something quickly. So first report the damage in writing. But until then, you’ll be sitting without heating.

Building Code Contract?

According to case law, subsequent repair is considered an acknowledgment within the meaning of section 212 of the Building Code ("...or acknowledges in another way") of the warranty obligation, provided the contractor did not clearly/expressly act only out of goodwill, i.e., precisely not in recognition that the previous work was unfortunately botched. As always, it depends on the circumstances of the individual case.

Consequence:
The warranty period begins anew (from the previous repair)!

Hopefully not the installation service for the Monday pump. Good luck, it shouldn't cost you any money.

Drama continues. According to the plumber, the manufacturer does not cover the repeated damage. The developer says it is not their problem and still maintains that the heating is excluded. The plumber is waiting. We do not receive the cause/error analysis, only that it costs €2,500. Legal protection says no coverage because it is a construction risk and not covered. So now good advice is expensive. Off to the lawyer and pass the whole thing on with an open outcome or reach an agreement.

Went back and forth with us. Down 3000-2000€. Had [Werkskundendienst] come. 500€
