Is the neighbor building legally and how do I find out?

I already wrote to you in #9, if you have a legitimate interest, the BA must grant you access. Of course, you can also ask a notary or lawyer what options you have.

"A review can also be interesting for the neighbor if construction is taking place next door and the neighbor wants to know to what extent they might be affected in their rights by the construction project."

Request access to the file in writing or orally.

This is probably associated with fees.

Who are you? The questioner? Then it's one of those state things again...

Yes, and I was also on site, asked about it, and was shown plans. I thought that was all the plans there were to see. The buildings and garage were drawn in as well as one of the garden houses.

Haven't they submitted a building application for the new house yet? [Akteneinsicht] is not letting you see. You can view the entire file.

So if the building permit does not require any exception, deviation, or exemption, there is no obligation to provide information on the part of the building authority in NRW, nor is the involvement of the neighbors necessary. If there are justified doubts, then the only option is through civil law regulations.

I strongly assume that all formalities have already been clarified. Surveyors have already been there, and the excavator is supposed to come next week.
At the building authority, I was shown a file in which building plans were visible: A3 (?) illustrations of the exterior facade and the layout inside on the ground floor and upper floor. Also, an overhead view of the property was included, showing the houses, a garage, and a garden house. Terraces were not marked. According to the building authority, as an adjacent neighbor I am entitled to inspection, which the neighbor should/must have granted me on site more easily.
So there should be a view with terraces marked? If yes, what is this view called?

Yes, and it concerns NRW.

According to my understanding, at least the garage outside the building window is an exception, since it is only permitted exceptionally according to the development plan.
