Is garage boundary construction possible?

This week, hopefully the boundary appointment with the surveyor will take place, then we will have clarity about the exact course of the boundary and whether the fence is exactly on it or next to it.

Apart from the ownership issues that we still need to clarify, is there such a thing as double boundary construction? Or does the garage at that location replace the fence? Can the neighbor (despite the building permit) insist that the fence remains standing?

I would say that, given the length of your left garage, you free him from his duty to erect a legal fence. If his corresponding fence section is too valuable to simply dismantle, you can offer to buy it from him so he doesn't have to cry.

Thank you for the answers! The fence is ancient, not exactly a pretty sight. I would prefer if it disappeared completely. But we still have to discuss that anyway, as it might be damaged anyway by removing the hedge.

In general, you can just demolish it and put a garage on the border.

Exactly, that’s what you talk about. Simply deliberately damaging something like that is out of the question just because you don’t like him.

Was there possibly an agreement between the previous owner and the neighbor?
Is he willing to sacrifice the fence? Does he even know that the fence is disturbing or that the hedge is supposed to be removed?

There was no talk of intentional damage, of course we seek a conversation and a good (and nice) solution for all involved!
