it's not that simple.. the landlord is a community of heirs, consisting of 6 people. They are already constantly showing up because they want to look after their house ... After that, we wouldn't have any peace at all

Have you ever told the landlords what's going on when they always show up unannounced to check their house? Or is it under monument protection and they are waiting for it to become dilapidated?

They can stand there as long as they want, but if they haven't made an appointment with you beforehand, you don't have to let them in and you don't have to deal with them if you don't have time.

I wouldn't stay one minute longer than necessary in a moldy apartment.

The expensive kitchen can also be taken out and installed in a new apartment; if it just starts to develop mold, it is worthless.

Why did you move in then? I can still very well remember our bad times; so I know what I am talking about. If you hadn’t moved in, the world wouldn’t have gotten worse, you would have just had a bit more running around... even with support from authorities if necessary. Now the other side will probably rightly argue that you knew about the condition of the apartment "before" moving in.


That won’t be cheap because the cause of the moisture must first be found. Interior insulation is always the last resort and not something for you to do. Regardless of the circumstances of moving in, the landlords must ensure that the apartment is habitable and without health impairments for its residents.


That is correct – but equally correct is that the landlords should have informed you about the condition and the expected circumstances AND they are liable to ensure that the apartment is habitable.

There is only one practical solution if you want to protect yourself and your children from this condition. Go to the tenant protection association or a lawyer specialized in tenancy law and simultaneously move into a holiday apartment.

Please also note that such structural measures must be approved by the landlord! In case of doubt, the landlord can otherwise demand complete dismantling and restoration of the original condition upon moving out!

Why did we move in? Because we moved to another city and then with children and all our stuff we would have been standing on the street. The landlord knows about that.... So far there are only small mold spots... but I know that is already too much. Then we will probably have to move as soon as possible.

As some have already written, I see exactly 2 possibilities here: a) tenant protection association + lawyer (which certainly won't be pleasant) b) move out and take the kitchen with you I would clearly tend towards b) if I were you.
