May I ask how you justify your "therefore"? The area to be kept free is not garden land. In the old construction stage plans, there are usually no building windows or building boundaries, but the area to be kept free should actually or, in my understanding, only be a "front garden area." Therefore, the full plot of 546 sqm is used for calculations. Or was this conveyed to you during the conversation?

Good point! This is indeed not a new street line but a building line. Accordingly, the garden area should be taken into account with the size of the property. Only the building window is significantly restricted.

Additionally, I have just learned from the architect that for such old development plans (1960), terraces are not yet counted towards the floor space index-1. Does anyone happen to know this?

I think I've heard something like that before as well. But from very far away...

What also helps to assess the situation is looking at the surrounding buildings with Google Maps. Even more so with old development plans.

And now I have just found the following again on the website of the City of Hamburg: "When determining the relevant area of the building plot, areas that are not intended for construction according to their designated purpose are disregarded, for example, areas located in front of the street boundary line fixed in the development plan or designated private green areas (garden)." That contradicts everything again, doesn't it?

I think you are mixing up or confusing some things. My opinion: nothing from the plot lies in front of the street boundary line, but rather what belongs to the street, i.e., in front of the plot. The distinction to garden land is also clear.
One must also consider that not only simple plots are regulated, but entire areas.
But of course, one can never be completely sure since we do not know the area; hamburg (dot de) regulates its city in its entirety.


For example, you have to build up to a building line…


Do you have a nice Google Maps picture? Is the plot in Sasel or nearby?

Here is an excerpt from Paragraph 19 of the Building Use Ordinance

(1) The floor area ratio indicates how many square meters of floor area are permissible per square meter of plot area within the meaning of paragraph 3.
(2) Permissible floor area is the proportion of the building plot calculated according to paragraph 1 that may be covered by structural installations.
(3) For the determination of the permissible floor area, the area of the building plot is decisive, which lies in the building land and behind the road boundary line specified in the development plan. If a road boundary line is not specified, the area of the building plot is decisive, which lies behind the actual road boundary or which is specified in the development plan as decisive for determining the permissible floor area.


You see, there is a before and an after the road boundary line.
