The house placement does not fit the plot. Rotate the house so that it fits within the building boundaries and harmonizes with the neighboring buildings in terms of alignment. Then these problems will not arise. The arrangement of house and garage can also be solved more creatively/variously and does not necessarily have to be the directly attached and set-back version. Both building structures can also be designed separately, with a passage and roofing as an ensemble. More courage in the design.

how much space is there "vertically" between the red and blue line (i.e. shortest distance)?

is the house now 10 or 12 meters long?

: It actually doesn’t matter how I position the house; it either doesn’t fit with the neighbor below or above. The reason for the upper orientation is the path of the sun and thus later (optimal) use of photovoltaic/solar. How you mean that with the creative design of the garage makes sense to me, but in my opinion it only works if I plan it much smaller. However, I am grateful for any suggestion.

: The house is supposed to be 12m long. The distance you mean is about 10.8m.

I am being selfish now too. The neighbors were there first and built their house accordingly. Why should they let you have your way now? I wouldn’t do it. Sorry, such serious planning issues should be clarified before purchase. We also can’t help you with your neighbors. You should have that fixed in writing as well. Whether the neighbors will agree to it—I rather don’t think so.

Hello

I would consider rotating the house slightly (front parallel to the left property boundary), placing the garage on the other side of the house (south?) as edge development, and using the garage roof as a terrace, accessible from the upper floor. There is already a building on the boundary on the lower property. That should cause the least problems. It would also have the advantage that you don’t have so many angles.

I don’t understand now where I am being selfish here? I am absolutely not trying to force anything through. Right now, I just want to find out what is maximally possible, with and without the neighbors’ consent. Basically, everything is still open! According to the development plan, I can overbuild the rear building limit without the neighbors’ consent with a one-story building, 3m high and up to 20sqm ... so if I want, I can get that area on the ground floor. Nevertheless, I want to talk to these neighbors beforehand, and if they agree that it can also be two stories, then I wonder why I shouldn’t do that? It would be, purely mathematically, about max. 4-5sqm that exceed the building limit ...

In the end, I just wanted to know "how" to best proceed with this neighbor inquiry; it’s already clear to me that I have to talk to them myself. If these two affected neighbors, for example, agree, does it make sense to get this in writing? Because until the actual building permit, they can change their minds at any time, right?
