Magdeburg is the capital of Saxony-Anhalt, Schwerin of Mecklenburg-Western Pomerania, place of residence according to OP Magdeburg, place of construction according to OP Saxony. Maybe the OP should clarify where exactly the construction is supposed to take place.

What exactly did you have approved? Did you submit the complete building documents, including proof of number of floors? And was this immediately checked there and found to be correct and approvable?

There are no half floors in building law. So only one full floor is probably allowed, and according to the plans, it looks like the planner did not apply the mathematical rules precisely.

Who are "They"? Is the municipality also the approval authority? If not, problems from "the others" may arise later.


You urgently need to clarify the framework conditions here, especially because the neighbor 7E currently stands too close to the boundary according to building law. Does this affect your planning? How much distance do you have to keep from him? How much distance must/may/will you keep from the street?

As you can see, the position on the plot has a big impact on the floor plan design. The planning law and building code conditions are therefore important in order to suggest better variants that are also approvable. The more information you provide, the better the advice.

I suspected the abbreviation SA in the registration process in vain... but it doesn’t exist, Google tells me the abbreviation is ST. I have now corrected this.



That of course has an impact. Unfortunately, the previous owner, out of naivety or whatever, agreed that the neighbor was allowed to come up to 1.50 m to our boundary. Therefore, on our side, we now have to keep about 3.50 m distance to the boundary in order to comply with the minimum 5 m distance required by the fire protection regulations. This gives us a maximum building width of 9.50 m on a plot width of 16 m. We have now agreed on 9 m in the given floor plans.
This has all already been absolutely cleared with the responsible building authority. Before we started planning, we already informed ourselves about what is even possible under these somewhat difficult conditions!

I have attached the relevant excerpts from the development plan.
However, I would also like to say that this is not set in stone, deviations are possible. For our case, for example, we had to apply for a change of ridge direction.
Our parcel is 29/9 at the top of the image.

There is a building line that the eastern neighbors did not adhere to, but the western one did.
Is the position of your building structure finally fixed?
Do you have to/want to adhere to the building line and/or building boundary?
Are you allowed, in deviation from the development plan, to place the carport between the street and the building line?

That is why I also raised the objection that this is not set in stone and deviations are possible.

We find the specified 10m ideal and would stick to it.

According to the development plan, as far as I understand, this is not possible. Since we had not considered this so far, I cannot estimate whether a deviation is possible. We would have to present ourselves again and question that.
