Exceed the boundary of the development plan

We also wanted to set our house a few meters further "back" to have more space between the house and the terrace towards the street.
An exemption application for exceeding the building boundary was rejected by the city in our case.
However, we were told that there is a "de minimis value." Here it is 10%. In other words, if the area that exceeds the building boundary is less than 10% of the total built-up area, it is not a problem.

We were then allowed to build 4 meters further back instead of 5 meters.

Maybe you have a similar regulation too!?!?

A residential building is to be erected on the side of the plot where the red marking is. (Distance to the street does not matter here)
If I had drawn in a scale, it would also be clear that all necessary distances to adjacent houses could be maintained.

Good evening,

once again explained what happened:

Preliminary building inquiry according to §73 Lower Saxony Building Code submitted via municipality, collective municipality, and district.
Attached cadastral maps with marking of the location where a residential building is to be erected. The footprint of the house has not yet been planned and it was also not necessary to specify this; it was only about whether another residential house may be built on the property.
As a response, a written invitation to a personal meeting was received.
There, it was verbally explained that part of the property lies outside the development plan. We then asked for some time to reconsider the withdrawal of the preliminary building inquiry.

But I still don't understand. Is the existing, surveyed plot partly outside the development plan? You want to build a second house on the existing plot?

All well and good - but without plans, no one can help you. From the drawing uploaded here, no information can be derived that would even remotely help you.
