That is exactly what unsettled us. In our notary contract (concluded during the development phase) it states that the property is sold in its current condition. Claims and rights due to material defects, especially regarding the area measurement, ... are excluded.

It simply did not occur to me why you wouldn’t just place four boundary stones in each corner. Then everyone would know what the situation is.

What I have learned from this thread now is that the boundary stones lie on the boundary but do not have to represent the corners. Our property will have the specified area since the lines on the plan apply and not the position of the boundary stone.

If I have understood/reproduced everything correctly, I no longer have a problem, as my property will not be smaller than stated in the land register. It was not about +/- a few square meters, but 19 are indeed a significant part of the future garden area.

Hello, the boundary point is marked indirectly. However, this does not change the plot size! If the surveying office has decided so, it is not possible to mark (set) the point there. As it looks on the present plan, the new development area was previously separated (purely calculated on the computer). (So that the parcels can already be sold). If you have any other questions, feel free to ask. This is how I earn my living.
