Deviations in marking in the new development area

Hello dear forum,

Today we received mail from the surveying office of our new development area. It confirms what we had already suspected when inspecting the boundary stones at the building site. The plot was marked differently than indicated in the purchase plans and the development plan.
One boundary stone has not yet been set or drawn in.

According to our calculations, this means that the plot is not 523 but only 504 sqm, so about 19 sqm smaller than stated.

Of course, we will contact the office on Monday, but maybe someone can already give us a tip on how to deal with this or what to do.

It looks as if the Grenzenlos all remain. The border point does not seem to be in the corner of the property. But that is basically not a problem. Where exactly do you see a problem?

I had expected that the boundary stones are placed in every corner and thus represent the outermost points. At least that's how I understood it from Wikipedia.
So the specific concern is that the property boundary is determined by the stones and that our property is now smaller than indicated at the time of purchase and the boundary therefore runs differently. Is that not the case?

If the lines still apply, I can be relieved and can calmly clarify my open questions with the office.

I could also imagine that there are tolerances, but why do you place the stone 1-1.5m away from the actual boundary and not on the real boundary? And why is one left out completely? Questions upon questions.

The boundary points are NOT always the corner. As soon as a boundary has a small "kink," a new boundary point is set there. The survey only knows lines and no curves. ;)
Why exactly the point on the boundary line is marked locally and the one outside is not, may possibly be historically caused. The office can also inform you about that.
The property or rather the plot is determined by the lines and not the stones you can physically see. So according to the cadastre, the point (without stone on site) next to the red square, from the cadastral excerpt, is the outermost boundary point of your plot. The stone is then "only" there because the boundary makes a "kink" at that point.
I hope I was able to shed some light on the matter, even though my training was several years ago. :)

PS. Upon request, the office can also mark the remaining boundary points for you, but that costs money and I don't know if that is desired. ;-)

For us, it was exactly the other way around. We bought 1,449 sqm. After surveying, it was now 1,462 sqm. We did not have any boundary stones and still do not have any now.

This question has not been answered yet… you read here the word fear… dread… Otherwise, people are already moving away from boundary stones in new development areas because of this. I have heard that they fluctuate very often and that it is supposed to be stated like that in the contracts?! But usually, a few square meters, whether more or less, do not make a big difference. Hence the question above.
