Construction project - multi-party structure - experiences?

Thank you very much for the numerous responses.

I will try to answer all the open points together.

Regarding the project developer: I believe there is not much to change from the current design, nor is it really necessary. That means: the developer seems to be working more or less exclusively with the seller (at least for the time being) and does actually offer added value (especially for someone like me). The PE also listed the ad on ImmoScout, which is how we became aware of it. Overall, he wants just under 40k (per house) – it’s not cheap, but otherwise we would probably have needed someone (an architect?) to take care of all that. He gets paid depending on the service, mostly directly (then after the preliminary building application and after the demolition has been arranged).

Regarding the contract/notary: there are contracts between us and the PE, between us and the seller of the land, and between us and the construction company (and mirrored of course for the other half). The notary was appointed by the PE (for the first two contracts, the latter is not notarized). The costs for the PE contract are paid by the PE, and we pay for the land sale contract.

Regarding the house/construction company: according to their own statements, they would also build half without the other being planned/sold. When asked whether it would actually be cheaper to do both at the same time, this was denied. It is a company of the Favorit brand, if that means anything to you.

If you choose this structure, keep in mind that you will probably also have to pay real estate transfer tax on the house construction.

Thank you for the hint. In fact, that is also an uncertain point. The PE and the contractor repeatedly emphasize that we only have to pay real estate transfer tax on the land - because basically, we are free to build whatever we want on it. However, I have also received other answers in this regard (i.e., real estate transfer tax on everything).

So an intermediary activity, like the broker. Who pays the broker? The owner hired the broker. Not bad, the hawk! Just for organizing, but you cover all costs (demolition and permits) Since it already exists, despite different contracts it is a tied deal.

Basically free or are you free? Then you don’t need the project developer with his planning and the house builder.

We are not free when it comes to the project developer; that is predetermined. Regarding the construction contractor/house builder, we could also choose another one.

P.S. Brokerage fees only apply to the land; there is a broker involved there. The "brokerage activity" of the project developer is part of the project development contract.
