Construction obligation by bank or municipality? Land purchase contract

If it is only part of the contractual obligations, then no one can take the property away from you later, but you may be liable for damages.

Typically, however, this is recorded as a real right of retransfer in the notarial contract and entered in the land register. Then the bank can demand the property back.

In this respect: yes, it is possible. But with appropriate argumentation, the period can probably be extended.

"The buyer commits to develop and use the property in accordance with the contractual agreements in § 1 (3). The buyer shall construct a ready-to-move-in single-family residential building within 18 months from the registration of the buyer as owner in the land register."

However, "from the registration of the buyer as owner" is changed to .. "from the building readiness of the property" ..

I myself had a 2-year construction obligation, submitted an application to the municipality, and it was extended to 5 years

We had something like that too. Bought a plot of land from a builder - in the notary contract there was a reference to the purchase contract of the builder, who had bought the land from the municipality. And it also said "ready for occupancy by xyz". That would have been impossible to meet in our case, the shell construction wouldn't even have been finished by then. I called the municipality and asked, and they also said "oh, no problem at all". I wrote an informal application for an extension until xyz and got it approved quickly.

Hello, if the shell is only standing 14 months after the purchase and you know it can't be done, a quick call to the city.

No one will probably insist on dismantling and reversal. The "will" to build has already been shown.

It will be that the prime pieces will also be sold quickly and only edge plots remain.

It would be unfair to the other builders if Schmitt Müller has 3 years and Krämer only 1.5 years.
