(4) When determining the floor area, the floor areas of

garages and parking spaces with their access roads,
2.
ancillary facilities within the meaning of § 14,
3.
structures below ground level that only underpin the building plot,
must be included. The permissible floor area may be exceeded by up to 50 percent due to the floor areas of the facilities referred to in sentence 1, but no more than up to a floor area ratio of 0.8; further minor exceedances may be permitted. The zoning plan may provide for provisions deviating from sentence 2. As long as the zoning plan does not specify otherwise, the limits resulting from sentence 2 may be disregarded in individual cases.
This is what is stated in the Land Use Ordinance. However, you have to do the calculation yourself now, as it depends on your planning.
So the zoning plan does not exclude exceeding the floor area ratio, at least I don't see that anywhere.
50% must be tolerated, we agree on that as well.
Is 50% related to the entire floor area ratio or only to ancillary facilities?
Specifically;
750m2 plot x 0.4 floor area ratio = 300m2 + 50% (exceedance) = 450m2 (total of all floor areas)
or
750m2 x 0.4 = 300m2 of which 225m2 is house floor area so from the remaining 75m2 + 50% (exceedance) 37.5m2 = 375m2 (total of all floor areas)?
