Building window on the corridor map - approval

Hello everyone,

I would like to buy a plot of land. The owner also wants to sell, but there is another problem.

The building window that the city has set for the plot is "unfair" in my eyes. My plot is on a street where three other plots are located. My plot is the only one where no house has been built yet.

Now, the building window stipulates that I must leave a 6m distance to the property boundary. I find this unfair because everyone else on this street has only left 3m distance, although according to the building window, 6m would also apply to them. I assume the other houses have been there for 50 years and some idiot decided in 1975 to "correct" the building regulations. Now there is a 6m distance.

The plot thus allows a building size of 10*10, but I urgently need (because it is a prefabricated house) 11.44m * 9.48m. So I need these 3m more at the back.

Now the question is, does the city also have to approve the 3m? Do I have a right to it if the others would also have it? Can I effectively defend myself against this unequal treatment, or am I at the mercy of the office? How is that?

Of course, I can submit a preliminary building inquiry. This costs about 500€ and takes about 4 to 8 weeks (if there is a paper jam at the office printer, also sometimes 12 weeks). In that time, the plot is probably gone.

You will have no rights regarding neighboring buildings.

Building envelopes are also not drawn according to "the same for everyone," but usually serve to protect the next one – at the front mostly the street and the appearance of the street lines. Edge plots therefore usually have a smaller envelope.

It is also necessary to first buy a plot of land and then focus on the house itself, as the house, floors, floor plan, and room planning absolutely depend on the location and the [B-Plan]. You generally adapt the house to the plot, not the other way around.

Nevertheless, I believe that a conversation between you and the building authority in private will be very fruitful for you.

That is of course true. However, when it comes to the external dimensions of a prefabricated house, you are not free. The size of the house to be built is 11.44m * 9.48m and cannot be changed. Sure, I can put a different house there, but then I am no longer building what I want.

So if the house does not fit on this piece, it must be a different piece.

You say a conversation behind closed doors with the building authority is very fruitful. Can you explain that in more detail? Whatever is said in such a conversation is just lip service, isn’t it? If I want to be sure, I have to submit a preliminary building application. I cannot buy a plot based on the fact that Franz from the building authority says "we’ll manage somehow" and then Frieda from the approval committee says in the final building application that the house is too big.

And that’s exactly why you don’t fixate on the house before the plot of land is purchased

If plots of land grow back for you or are available in sufficient quantities, then it has to be a different one.

Because although I assume that the building authority can be negotiated with or that an architect with a good design gets an exceptional permit, this is not sufficient for you now in the decision/purchase phase.

And here lies the catch: if you are still open with your house or design, the plot with its advantages will probably do justice to your house construction
You first buy the location, and then you develop the house.
What if the next plot has a different orientation? Not suitable for the house? Front door?
That would be comparable to buying shoes without knowing your shoe size or your outfit.

But this raises the question for me: doesn’t Weberhaus also build custom?

I am always flexible with the interior construction. Also with where the front door goes. I can move everything. The only thing I really can't change are the exterior dimensions. Although that is possible with Weberhaus, it would mean falling out of the standard series. The friendly salesman said that if you plan freely with Weberhaus, it immediately costs 20% more than the standard series. That obviously breaks your neck when building a house.

I have no interest in a plot where the desired house no longer fits. What is special about me is that I want a home cinema in the living room. For that, I need a living/dining room that is at least 8m long and 5m wide. I don't want a basement; that becomes too expensive. So if you want a living room of 40sqm on the ground floor and only have a building envelope of 10*10, you get a problem. Guest WC, hallway, kitchen, utility room, and stairs also have to go somewhere.
