That is indeed true. You are not registered in the land register, you are not in the loan contract. Therefore, you are not a builder in the legal sense!
Therefore, you must be insured accordingly for activities on the construction site.
Is that really the case? The BG Bau itself excludes spouses and life partners from their insurance coverage.
There is the possibility to insure oneself _voluntarily_. That means BG Bau is excluded for the spouse/life partner. So why does it matter whether someone is also a builder or "just" a spouse? He/she is not insured anyway...
After that, BG Bau really does not give a damn whether someone is registered or not.
with us they also wanted a lot. ended up in the trash. after the construction there was another letter. I sent them the list of trades from the construction company (instead of tediously filling out every line on their form), wrote "no own work" underneath and emailed them that they could shove the rest up their ass. never heard from them again...
One might think that those who use 100% external capital would not have any undeclared work on the construction (consciously), since every euro has to be accounted for with a receipt to the lender. Accordingly, owners with equity and/or own work would be more suspicious. But this is just my attempt to find some sense in this strange question. If I were right, this way of asking would be very suspicious to me.
bg Bau has less to do with illegal construction but rather with how much you actually do yourself. they want money for you having done the work yourself. if you build with a construction company like we did, all the trades are predetermined by the company. we got through bg Bau quite easily then.

they want money because you did the work yourself.
AFAIK they want money for accident insurance coverage. The details may not be optimal, but overall I think it's good (the professional accident insurance and what goes along with it). Of course, if you don't do any work yourself, you don't need such insurance.
I already have accident insurance myself and my and your health insurance pay for the treatment of your minor ailments that occur during construction. Only the insurance would pay for loss of earnings (after a long legal dispute where you go bankrupt beforehand...) and you would first have to be off work for 6 weeks. Overall relatively worthless unless you want to do roofing or similarly "dangerous" work yourself. Of course, the experts here see it differently again. At least I don't know anyone who receives money from the [bg Kasse]...
