If it makes you happier, then get a lawyer and sue. But don't expect it to be cheaper. The lawyer also costs a lot. You just belong to the incorrigible ones in this world who chase principles rather than reason.

The VG decided today and agreed with my view. Anyone who finds the wording "balconies, loggias, and terraces are not included if and to the extent that they protrude beyond the building line" in their BGS/WAS (included in the model BGS/WAS) can be happy. Contrary to current recommendations (Thimet), these are to be exempted from contributions according to the ruling issued today! If someone happens to have this topic on their desk right now – an objection is likely worthwhile, as this billing method has now lost its basis.

Thank you for the feedback. I just had the issue as well, although the terrace did not play a role here. I find it overall unfair that the costs for sewer construction are calculated based on the floor area including the basement. How does the size of the building relate to the amount of wastewater that will be discharged? Why is this not financed based on actual water consumption or discharge? In our town, the fee is 20€/m². That means for 80m² floor area with basement, the sewer construction fees amount to 4,800€. This is only for the wastewater; in addition, there is 2.5€/m² of land area for surface water and 3.5€/m³ for the water connection.

That the production costs are determined based on the areas is absolutely understandable to me. The usage costs, on the other hand, are billed according to consumption. That covered terrace areas, however, are considered like living spaces is a completely different matter.

Hello R0LI84! We are really happy that you shared your problem here, because we have exactly the same issue right now. We already won the case regarding the contributions for our garage, so it was worth not giving up. Now we have to pay for the terrace roof. The municipality rejects our objection here and wants to forward it to the district office for a paid review. Maybe you can send me your ruling or file number? That would save us a lot of trouble!
