What exactly was discussed with the district building officer?

Are you sure you mean development plan and not land use plan?

If you want to get advice here, you first have to clarify the planning law with the municipality or the district building officer. According to the land use plan, the property is still located in the village area (MD). According to the land use ordinance, a maximum floor area ratio of 0.6 is permitted here. However, house no. 38 is already located in the agricultural area. On what basis was this approved? Do you still operate agriculture?

No one here knows what you find nice. Please draw a scaled site plan of the property and place your desired building volume on it, taking into account the planning law you have gathered. Note that even if you ignore the minimum distances of 2.5 m to the property boundaries in anticipation of your family’s approval of the construction burden, you must maintain at least 5 m distance to the existing buildings. Then design your desired floor plan on graph paper and let it be discussed here.

It's also understandable when you believe you can fully build on a plot, which doesn't even have 240 sqm, and everyone in the world tells you that it does NOT work THAT way. Nepotism or not - I would also be gasping for air.

Especially the sister will be thrilled: Since he was supposed to receive the property, she will surely get financial compensation. However, according to the new facts, this will likely amount to just a four-digit sum (if at all) for the undevelopable strip of garden land.

First of all, thank you very much for all the answers, even though I can't really understand the tone of some of them. I am just starting to get into the whole topic and trying to evaluate the options I currently have. It is obviously clear that I lack background knowledge here – constructive criticism helps me the most. I don't want to build next year, but rather look at the perspective of whether I can realize my plans within 3-5 years with the existing conditions or if I have to deal with alternatives.



Content-wise, Escroda’s post definitely helps me further, so here are a few more details about it.

The goal of this thread was initially to find out if the property is even suitable for construction. One scenario would also be to place a small house built for elderly parents on this property; for this, the area might be suitable, and I would redesign the existing house according to my ideas. Since I could alternatively purchase another property at the moment, it is first about figuring out what can be done with the existing property – so no one here should get hysterical. The comments about the rural area and nepotism – not everyone necessarily has to live in some supposedly great metropolitan area and then drive to the countryside on weekends to recover from city stress. I know both sides and consciously chose one. By the way, in an area where other people actually go on vacation and which has one of the lowest unemployment rates in Germany. Everyone as they like, I would say...
By the way, my sister is not receiving any financial compensation for the “green strip” and the house, so your worries are unfounded in that regard as well.
