Welds on the painted railing - assessment?

Sorry for only getting back now, but nothing happened in the matter until yesterday. However, there is finally news, and from now on it gets really absurd! His handling of the repair work even surpasses his previous work.

This morning, I received an email from him claiming that the agreed acceptance date for his repair work was yesterday, on 7/8, and that we (and our neighbors with similar problems) were not on site, so he now considers the railings to be free of defects. Of course, this email does not exist. By then, I already had a pretty good idea of what to expect, so I just drove to the construction site to take a look at his "work."

As mentioned before, he said he would repair the spots so that the damage would no longer be visible.

He has already received my response to his email. This is, of course, unacceptable. And with such a ridiculous attempt to swindle an acceptance, he certainly won’t get far and has wasted any chance that I would turn a blind eye somewhere. I’ll keep you posted.

show him this as an expectation. Railing, welded and painted.

That reminds me of the very old joke about the tomato sauce stain on the shirt that was simply cut out with scissors, hahaha. In the picture, from top to bottom, the following seems to be shown respectively: a small corrosion protection defect that apparently has grown / a welding wire spatter adhesion, ground off and the grinding scar painted over / a welding wire spatter adhesion, ground off, the grinding scar painted over and additionally the top side of the railing ground down there. Funny (or not - depending on your sense of humor). So he arranged a meeting with you, but told you nothing about the appointment and of course you weren’t there? Implied acceptances of defect repairs do not exist. Absent parties can’t sign anything. Insofar as he stands there empty-handed, it cannot really be called extortion. A successful crook would be richer by a loot after his heist.
