Turnkey construction offer - How was it with you?

Hello everyone, we received a fixed price offer today from our preferred [GU]. We have already attended two presentations where our house was shown and our wishes were incorporated into the planning. Now the offer has arrived and, so far, all wishes and requirements are listed. The price is also acceptable. But unfortunately, the floor plans are missing?! Apparently, they will only be provided after signing. But what exactly are we signing now? In my opinion, the offer does not yet constitute a legally binding construction contract, does it? Neither payment terms, start of construction, nor anything else has been clarified. What happens if we accept the offer but the construction contract does not come into effect for some reason? Can we then withdraw from the "offer"? Thanks for your answers. Regards

No floor plans? Without at least a rough direction, I wouldn’t bet on a fixed price. Everything should be clarified before signing, heating, floor coverings, walls, doors, bathrooms "bodengleiche dusche", chimney—anything you haven’t clarified beforehand you will pay dearly for later.

For example windows, you only have 10 but want 11 and then you have to bleed.

Sockets and switches should also already be clarified in terms of quantity beforehand.

And so on.

Hi Tomtom,
all the details are in the offer or construction service description. Everything is available. A floor plan and how the house is situated on the plot exist on the architect's PC.
But all the contractual matters like start of construction, payment schedule, etc. are missing.
Is it common to first sign the offer and then create a construction contract? I think they want to avoid that you simply take the floor plan to another provider. Because the architect has already invested a few hours in us.

We have signed the contract for work, the construction performance description, detailed additional equipment with type designations, as well as all floor plans from both sides (provider and buyer). I can only strongly recommend this, because even with drawings, there are still discussions later about the execution. Without them, it will definitely be quite exciting what will eventually be built.

The start of construction depends on the approval of the building application. However, the payment schedule is regulated in the contract for work.

Don't sign anything and get independent advice first ([Bauherren-Schutzbund] or [Verband Privater Bauherren]). Otherwise, you're buying a pig in a poke.

It is called a contract for work, which is what matters. The construction specification is attached, and the house is described with size, number of rooms, and roof shape, possibly also with a drawing as a basis. I consider all preliminary contracts to be unnecessary.
