Traffic area providing access to a building plot

Good morning everyone,

maybe someone of you can help me.

It's about the annoying topic of privacy screens,
we have bought a corner plot - see picture below

We would like to install a privacy screen on the street side / south side as marked in red below, because our terrace lies 4.00 m behind it.

Since we have a corner plot, both streets are to be considered as access roads for us, right?
Therefore, in my opinion, point 7.2 would apply?

We would also fence in front of it again with angle supports at the required height.

The development plan is currently only available as a draft, council decision not before 14.12.2020 - see texts below from the draft

So clearly §5 states:
a fence may only be 0.8m high, a hedge higher. (no Thuja allowed, I already find that nice).

In 7.2, the question for me is rather: how far from the terrace may the privacy screen be. There is surely a definition for that as well.

"die das Baugrundstück erschließende Verkehrsfläche" is your red planned street - because that is where the development takes place, i.e. from where the house connections are laid. Or do they come from the gray street below?

I see it the same way as Weststrasse is the access road, for enclosures 80 cm to public paths apply. Exception: these native plants, as named. Point 7.2 does not refer to height, but to a distance to the rear building boundary opposite the access road at the terrace.

First of all, many thanks to both of you for the quick response and the effort involved!

According to the text, from point 7, I am of the opinion that it is allowed to place 3.00 behind the building envelope!
Since we only have 4.00 m to the property boundary/enclosure, I would not mind having the meter between the enclosure and the privacy screen, I would enclose with angle supports and also place the privacy screen.
I really see the problem in the access road, but aren’t both to be considered as access roads?

I will probably only find out where the house connections will finally come from in December.

Currently trying to find out through the surveyor which one is the "access road."

No, the access is the place where the supply lines come onto your property. That will certainly not be from both sides.



Yes, maximum, but to the rear with regard to the access side, as in your case:
Access in the west, the 3m apply to the east side.
There is nothing about the position to the south (i.e. how far away from the terrace).

But I wouldn't make such a big effort there, rather plant a nice mixed shrub hedge anyway, and then for the first 1-2 summers install a provisional privacy screen each time, which can later be removed once the hedge is dense enough.
Then from the terrace you have a nice view of greenery and not a wall.
