Hello,
I think this will have to go through your builder’s insurance.

    [*]You do have some nice pictures, but unfortunately there is no truck shown in them. You probably also don’t have any pictures of the condition before the truck arrived. So you can’t prove that this damage even occurred on that day, and even less that it was caused by this truck.
    [*]It is absolutely certain somewhere in the fine print that the access road must be designed for a 40-ton truck. And this road definitely is not…

Usually, the fine print also states that there will be an inspection at some point to check whether the builder has met all the requirements. If this inspection took place, as the builder I would pass the blame on to the construction company.

I have never read anything like that before. I also wouldn’t include that in the contract as a company, because that would only cause me problems.

If that is the damage the neighbor is lamenting, then I am no longer at all surprised by the many neighborhood disputes in Germany that end up in court...

The thing is that the street already had pretty severe damage beforehand. There are already grasses growing out of the holes. The only stupid thing here is that usually the residents have to pay for a "complete renovation" (unless it is a private street). Costs are simply passed on. The game of cities/municipalities always follows the same pattern: not repairing streets (the city/municipality has to bear that itself) but letting them deteriorate until a total renovation, which is the only cost that can be allocated, becomes unavoidable. -> Fence "private" to be arranged through insurance. Leave the street be until it is renovated. Unless you want to "wake sleeping dogs" and approach the municipality to point out that the street is in a pitiful condition and you are willing to contribute some thousands of euros to get it properly renovated :p
