Hello,

The site manager should have commented during the inspection?

What "others" think about it is of little use to you. You have to look at your past construction period and especially how problems that arise were handled.

Since the scratch is not directly in the visible area, I would at least have it polished: the entire lower front where the scratch can be seen. Afterwards, at least it looks like "it has to be that way." It will still catch your eye because you simply know about it; however, a casual observer will hardly notice it.

I wouldn’t want money, but an (almost) invisible compromise

Edit: with my suggestion, the issue of ugly notches to the left of the scratch would also be resolved in one go.

Rhenish regards

we were offered 100€ by the site manager!

A partial repair, in my opinion, is not possible since too much would need to be removed, right?
So now I'm trying to find an amount I can live with and have to accept.

I will ask him if it is possible to polish the entire 3.5m. Presumably, the silicone joint would have to be removed for this.
Then a skilled worker would be occupied for 4-5 hours, I need vacation, etc.
If this is rejected, I will try with 200€ as a counteroffer.

Throughout the entire construction period, there was not much to complain about and actually everything was repaired to our satisfaction.

How is a field of view defined? It practically jumps out at you there at the lower frame above the floor, doesn’t it?

I recently had this topic in another forum. Conclusion: companies can botch things however they want, deliver however they want, but you’re always the one who’s out of luck. Because in construction, errors eventually become disproportionately expensive and have to be accepted through the emergency plan (a few euros).

The following legal remedies are normally available, but usually don’t work in construction:

- Deliver the product anew. But this is not possible if it’s installed, since that would be disproportionately expensive.

- Withdraw from the purchase contract and return the item to the company. This is virtually impossible for all installed parts, since you might even lose money doing that. How are you supposed to return your patio door? Should your house stand without windows or doors? The new door (from another company!!!) certainly won’t arrive simultaneously with the removal of the old one. Furthermore, more damage can happen in the process than was there before. And of course, it’s always disproportionate.

- Remedy by repair. Usually not possible for cosmetic issues.

In the end, compensation remains. Since all other legal remedies don’t work (for your protection!), they have no real interest in giving you anything special for it. Apart from outstanding invoices, you have no leverage.

Going to court is also a topic, since no legal protection insurance covers construction projects (they know the customer is always the fool). In the end, you almost always settle, and you could’ve saved yourself the entire ordeal. It’s actually a pity that companies basically have carte blanche in construction in Germany.

An outstanding invoice is really the only option for quality work, because you simply do not pay until the work has been carried out as agreed. With luck, they might go bankrupt before that (craftsmen often go bankrupt if customers don’t pay). Of course, the craftsmen will complain, but legally you simply have no other options.
