Purchased house does not meet B plan

It's a pity that I'm not at home right now, otherwise I would quickly check our Town & Country contract... I'm curious right now whether or how something about that is included, but it's been too long for me to still have that in my head.

So I wouldn’t immediately consult a lawyer, but first calmly gather detailed information:

- Have you actually read the development plan yourself in detail? Does it really state that only 2 full stories are strictly permitted?
- Who exactly wanted to submit the building application? You have to be authorized to submit it, such as an architect, structural engineer, etc.
- If the development plan really prescribes 2 full stories, I would talk to your building regulations office to see if they can imagine an exception. Usually, it is easier to build smaller than allowed than bigger.
- If necessary, just submit the building application anyway and hope it gets approved.
- Otherwise, I would discuss with Town & Country what would need to be changed for the house to have 2 full stories. Maybe a slightly higher knee wall / dormer, a somewhat flatter roof, or a slightly higher clear room height on the upper floor would suffice.

Most people rather have the problem that 2 full stories are not allowed and have to reduce the house to 1 full story (1.5 does not really exist).

The type and number of floors are stated in every development plan, how can someone not notice something like that?

You better start accepting that you have to bear the costs.

I can understand that: It says 2 floors and one thinks that 1 full floor plus an attic floor would meet the definition.


Talk to Town & Country!
A few tips on technical solutions and alternatively on approval have already been given.

It always says from - to or fixed specifications. For example, SD 22-45 degrees or SD 45 degrees. It is also stated in the legend of every development plan.

Talk to Town & Country. Maybe they are quite lenient if Flair 125 is swapped for Townhouse Flair 124. Nothing has happened at Town & Country yet. And please find out what is really stated in the [B'Plan]. A builder always still has to inform themselves.
