Private road = Building land? Who pays which share?

Thank you all. @ Dirk: I will upload the map shortly... but it is a dead end. Is the city even interested in participating there?!?

Always the property owner... unless the mound was created arbitrarily and it can be proven by whom. That then in total is not EUR 80,000, but just under 74,000; not exactly little, but still manageable for 3 parties. Visual material would be good; just please remember, the pictures must be license-free or owned by you. Rhineland regards

Our property is the one at the top in the middle - to the left of the street is my friend's and below ours is the third party's. The property at the bottom right is not building land

From the plan it is clear that other plots are also accessed via private dead-end streets. I think little to nothing of that; it is only done in emergencies. It is also planned narrow, no turning possibilities, no parking spaces; all of that will be shifted onto the plots.

So that would have to be my absolute prime location before I would personally agree to it.

Ask the city or the developer of the building area whether the street at the end cannot be handed over to the city; that saves partition costs because no separate cadastral parcel is created, and no building encumbrance entries are needed. Moreover, you are relieved of maintenance and winter service, etc., or it could be arranged with the city that winter service is waived.

Besides, the costs do not add up - for 370€/m², I can demand that the land is building land. But it is not; instead, you are supposed to pay the full building land price for land that is not ready for building and additionally has to be partially excavated to a considerable extent. This is raw building land at present, nothing more.

So you buy the 200m² for 50%-80% (rough estimate for raw building land, although in this case I would place it rather at the lower end due to the high costs for soil removal) and pay for the development, or I pay 370€/m², but then the street/development is completely finished.

Normally, neither of these can be imposed on you or would cause a corresponding increase in the actual (calculated) standard land value – that would effectively rise to over 400€. It may be that the location still justifies this, but in my opinion, the seller’s/planner’s/developer’s presentation is not entirely clean.
