I have the feeling that I heard yesterday on TV on "Baurettern" that such a clause is illegal. At least when you yourself, as the client, are on your own land.

In our case, something like this was included:

I consider that a sensible paragraph. The house rules remain with me, but I can't directly interfere with the contractor's work.

Maybe this could be suggested to the contractor?

I really wouldn't relinquish the house rules either; I am the client and owner, that's spelled G-O-D....

Best regards,

Andreas

Hello,

we have a contract that states that we transfer the house rights during the construction period. Okay, I could understand that if the construction company acted as a developer, but it does not. We purchased the property separately and we are listed in the land register.

Unfortunately, I am reluctant to hand over original documents.

Hello ypg, yes, we act as the builders, as it also states on the building permit. I will try to have a conversation with the construction company and ask why they need the original documents. We are happy to provide copies.

Yes, I am an accountant and a trained legal assistant and probably think and act that way because of it. I find recounting important, not down to the last cent, I'm not at work, but you want to have an overview, right? And no, I don't come around the corner with a lawyer immediately.

I have attached the passage as a file. It may not sound as dramatic as I might portray it, but the § is there. And I find it exaggerated to have to consult if I want to enter my property, and we are not the kind of people who want to watch the construction workers at work or bother them with questions. As already mentioned, I understand it if the property comes directly from the developer. And I think if a construction company has nothing to hide, they shouldn't mind!? And it goes without saying that the screed should not be walked on during the first few days.
