Original building permit documents to the construction company?

Dear forum team,

I am currently troubled by the following concern, maybe I am just too soft for the upcoming construction and think that the company might cause trouble... It may seem paradoxical to some, but unfortunately that is the case and I just want the construction to go smoothly.

We now have the building permit including all attachments.

Now the construction company wants us to hand over the original documents to them. However, I think we should keep the originals with us, because we are listed in the land register and not the company. Thus, they have leverage if something goes wrong.

How did you handle this?

Unfortunately, our contract also states that we transfer house rights to the construction company. However, I must say that the contract was signed before the purchase of the land. If possible, we would of course like to reverse this. The company has a good reputation. But I am fundamentally a skeptic and do not want to give up everything.

The magic words "certified copy" or "duplicate" come to mind spontaneously. Have they justified why they want the originals – is the construction company a developer, and you only buy after completion?

The construction (site) sign should already be hanging on site in the original, especially in black and white copies you wouldn’t be able to see whether the dot is red or green. However, I believe this doesn’t apply to all federal states that you need this.


They probably have their annoying experiences with senior teachers who trample the screed with a gold scale.

The building permit went to the general contractor in the original, why not? We got it back later, with additions where necessary. For example, the drainage slightly changed during the construction phase.
The building permit is not like a car registration certificate... why are you worried about that? How could they use that as leverage? Are you afraid they might secretly change the plans again?

Transfer house rights? Yes and no. If it is your land and a general contractor, it is and remains your property and you are allowed to enter it.
We had the right to enter the construction site at any time, always had a site key but no authority to give instructions to the craftsmen. Maybe they mean something like that?

The path was, permission was given to us, to BU, who made copies of it, we received it back. Since there was no developer with us and it was our land and our building, we had the house rights, but thus also the security obligations. Since the craftsmen are not my employees, I had no authority to give them instructions. That is normal. If something is to be different, it must go through their boss.

First of all: what kind of contract do you have with the BU?
Does the property belong to you?
I assume so, because the builder is named on the building permit, and he also receives the original. So in this case, you.

Of course, you can hand over the permit, and you even have to give it to the BU, but why the original if a copy is sufficient. You are the owners of the permit.
And the house will belong to whoever is listed in the land register, not to the one who has a permit in hand.

I assume you somehow misunderstood the BU [emoji4]

Our building permit has also been kept by the GU in the original. In the Bavarian BO it states: Please ensure that for projects requiring approval you have certain documents readily available at the construction site from the start of construction and throughout the entire construction phase: building permit construction documents structural engineering evidence that are not already construction documents certificates from expert inspectors
