I would be very surprised if major banks still use flawed contract documents today. It probably comes down to talking openly with the bank and limiting the damage.

Obstlerbaum, they have no contract with banks, but with a house seller. The contract becomes void if no one finances them, explicitly including BHW. But BHW finances EVERYONE. Regarding Caspar: I do not accept that as an excuse for such sellers. There is such a thing as the honorable merchant, known not only in Hamburg, and there are cutthroats, fortune hunters, etc. The latter, in my opinion, deserve no understanding. Karsten

I completely agree with Karsten. With that argument, any mess can be justified. After all, you’re just a cog in the machine...

Understood, the contract with the bank hasn't been signed yet? Then at least the situation still looks dark gray instead of pitch black. It could still cost quite a bit of tuition fees though, keeping my fingers crossed...

Now it is important to meet the house provider on equal legal footing. Find a specialist lawyer for construction contracts. A general practitioner lawyer will probably not be much help here.

Tip, so that BHW doesn’t finance you either. Look for a private loan, as these are usually repayable without VE. Maybe with a 400-500€ monthly rate and say it’s for a car or whatever. Then your credit situation should be so bad that BHW won’t be able to finance you anymore upon request.
