Are you sure about that? Check the contract again, normally that is a standard clause when you buy such a new house from a private seller. In our case, it was somehow worded along the lines of "The sellers assign the .... blah blah ... claims for performance, warranty, and damages to the buyers. The buyers accept the assignment." Also relatively early in the contract.
