After page 18 ("Vertiefung") of the brochure, I would see the neighbor responsible for taking care of the lower 40 cm, provided he has not excavated with a slope. But this short user manual is only an overview of the range of relevant regulations and not a substitute for the full reading of the HNRG.

he has already lowered his level. In front of the garage about 50-60cm and behind the garage about 30-40cm from the original terrain. And I now have to raise mine similarly to get a relatively even terrain. And his statement is that I have to compensate for my raise and his excavation and bear the costs alone because it is supposedly regulated by law somewhere. But I have not found such nonsense anywhere.

That's exactly how I see it too and it sounds logical, except that I would pay for my own elevation as well.

currently yes, we only moved in recently, my neighbors a few months earlier, so relatively at the same time. He hasn't done anything because he assumes that I have to do it.


as 11ant wrote, this is probably just a summary and a full version of the HNRGs might be more insightful. I have also already contacted the Hessian Ministry. I don't want a dispute or trouble... because something like that might never settle again. But I am not willing to give everything away to others and then have to turn over every euro myself.

The brochure is a cross-section and offers quick-reader samples from the affected laws. State laws can usually be found, if not on juris, mostly on the websites of the specialist ministries or ministries of justice of the states, less often on those of the state chancelleries. Take a look at NachbG HE 1962.
