but this is an indication that the Energy Saving Ordinance standard is not an energy-related junk.

we did not receive any special conditions from the Commerzbank.

Rather a clear no to your wrong conclusion, the correct statement is: Today, newly built only the at least KfW70 house exists and therefore there is no special funding for achieving this standard with a new building.

Where is it written that the Energy Saving Ordinance must mean at least 70? Can't KfW 75 or 80 also be achieved in new construction?

No. That is why it is called "minimum standard".

The current building regulations for energy-efficient construction require that certain measures must be taken during new construction. These requirements correspond to what was previously the Kfw 70 standard. The latest Energy Saving Ordinance has declared this former KFW standard as the minimum building method. Every newly built house must (!) therefore comply with what was formerly KFW 70. This standard was abolished with the change of the requirements.

KfW Energy Efficiency House 70 – Funding Discontinued

Technologies that were considered particularly innovative a few years ago have meanwhile become standard in construction. Nowadays, new buildings without special additional features achieve the values relevant for a KfW Energy Efficiency House 70. Powerful and yet low-consumption heating systems, comprehensive thermal insulation, and triple-glazed windows significantly reduce energy consumption. Therefore, KfW discontinued funding for the Energy Efficiency House 70 as of April 1, 2016. In the current funding program "Building and Living," builders who wish to receive grants or promotional loans must plan at least to the standard of KfW Energy Efficiency House 55 or better.

That is why formerly KfW 70 is now equal to Energy Saving Ordinance.
Your house may no longer be built to any lower standard.
