what is it all about? What advantage/disadvantage does it have that the Bau-Bank cannot access the account?

The question is AFAIK whether the financing bank is allowed to terminate the mortgage loan and liquidate the house in the event of an overdraft on the checking account. This may not happen very often, but one would rather not have that (the linkage of the checking account with the mortgage on the house). Before getting lost in the fine print, one can play it safe and maintain the mortgage loan and checking account with different banks.

The bank then simply does not see the transactions or how much is on it. If conflicts arise, the bank could simply draw on the account (even if it is not allowed to do so) by initiating a transfer. Since it is a transfer, such a thing can no longer be easily reversed through the system like a direct debit.

, every bank has agreed on a lien in its terms and conditions. So they are allowed to... but when it comes to the point where the bank would want to use it, it is already too late. Even with two banks, because then you have other worries.

And in Germany, obtaining a title to access accounts at other banks takes about 1 month. So whether that still helps... I don't know.


And whether the bank secures the credit card loan with the property depends on the purpose declaration. But it is unlikely that any bank will go ahead and enforce the land charge because of a 3000 euro overdraft on the checking account and thereby liquidate the entire financing. Before that, there will be a lot of alternative attempts at solutions.

All statements naturally apply only to reasonable, reputable banks; this includes cooperative banks, savings banks, the major German banks, and the common direct banks.

That's clear. As soon as you have a title, everything is already much too far. But direct access is technically possible on the short service route, and I experienced it recently, even though it is legally dubious. The point is: the money is pretty quickly gone at first, without being able to do anything about it without a lawyer. And yes, it was one of the mentioned reputable banks.

No, it is not possible by informal channels. File a complaint with the [Schlichtungsstelle] and it will be reversed faster than you can see. At every bank. Unless you refer to the right of lien, then this will also be explained to you accordingly. A transfer without a customer order is simply fraud. And no bank likes to be guilty of this intent. Believe me.
